I didn't see your note before. I agree with your assessment. I think
that it applies also to the Regulatory Ombudsman position.
The only possible wiggle room is that "ex-officio members of the LMSC
Executive Committee" are mentioned among those that are "appointed by
the LMSC Chair and confirmed by the Executive Committee." The term
"ex-officio" is not mentioned elsewhere in the rules. It's not clear
what it means.
Robert's Rules of Order (1915 Public Domain Version) says "Frequently
boards and committees contain some members who are members by virtue
of their office, and, therefore, are termed ex-officio members. It
uses the example in which "the president is ex-officio member of all
committees." It's hard to understand how someone could be entitled to
an ExCom seat because of an office they hold, and simultaneously be
subject to appointment by the Chair.
Robert's Rules also says that an ex-officio member has the same
privileges as other members, including the right to vote.
Based on my current understanding, my opinion is that only the WG and
TAG Chairs are given a position on the ExCom by virtue of their
office. Since no other ex-officio positions are defined in the rules,
I think that they don't exist. It seems that, for me to think
otherwise, someone would have to show me a different definition of
